Legal mentions

The YEARBOOK website is edited by The European Audiovisual Observatory – 76 Avenue de la Robertsau 67000 Strasbourg (hereinafter "Observatory"). The pages published on this website do not constitute a professional or legal opinion of the Observatory, the Council of Europe or any other organisation, entity or person contributing to our website.

The Observatory is committed to respect for private life. Its policy on protection of personal data is founded on Regulation of 17 April 1989 of the Secretary General of the Council of Europe outlining a data protection system for personal data files in the Council of Europe. Where a user connects to the site, certain of his/her particulars, such as Internet digital address (IP), navigation round the site, software used, time spent and other like data are stored on the Council of Europe servers. Any personal information, such as name, electronic or postal address or other information, which may be supplied when completing the forms stored on this site, is not made available to the public, or disclosed or sold to third parties. The Observatory retains the data only for as long as needed for their processing and for the purpose to which consent has implicitly been given. Beyond that, the information is not re-used.

Terms and conditions

1. ORDERS

When ordering any information service or publication from the Observatory, the client agrees to the general conditions of use and sale set out below.

The client may use this website to order the Yearbook Online Service. The ordering process consists of various stages which are validated successively. Final validation comes at the end of the ordering process. The client can decide to abandon the order at any stage of this process. Orders may also be placed by letter or Email:

The Observatory reserves the right to cancel or refuse any order from a client with whom there is a dispute concerning a previous purchase.

2. PRICES

Prices are in euros and per unit. The prices applied to all orders are those that are valid on the day of the order.

3. VAT

All European Audiovisual Observatory product prices are exclusive of duties and taxes. It is the client's responsibility to contact the fiscal or customs authorities to pay any duties and taxes. Owing to its status as a Partial Agreement of the Council of Europe, an international organisation, the Observatory does not have an intra-community VAT identification number and does not apply any value added tax (VAT).

4. CONDITIONS OF PAYMENT

Payment is due at the time of ordering. Payment must be made in euros using one of the following methods:

  • Credit card – The Observatory only accepts Visa and MasterCard. Cards issued outside of France must be international bank cards. The facility provided on this site for electronic payment by credit card is fully secured thanks to data encryption using SSL (Secure Socket Layer) protocol. All data transmitted are encoded and may not be read in transit on the Internet. The Observatory does not retain any credit card details.
  • Bank transfer – The client who has chosen to process via bank transfer shall pay all bank charges relating to the payment. The details of the Observatory’s bank account (IBAN, BIC, …) are communicated to the client upon confirmation of the order.

5. ACCESS TO ONLINE SERVICES

Access to the database is exclusively reserved for subscribers. Subscribers shall not communicate the access code to any third person.

Online services are made available upon payment. The Observatory will process all orders swiftly after receipt of the corresponding payment. Once the client’s payment is validated, the client will be notified by email of his/her access codes to the online service.

The Observatory guarantees access to the Yearbook Online Service at least until the end of the second calendar year following the year relative to the Yearbook (e.g., the Yearbook Online Service 2017 is accessible at least until the end of 2019). It is the client’s duty to download the purchased product or service should they wish to assure access to it after this period.

The Observatory may not be held responsible for any consequences of a delay in processing orders or a delay or interruption in providing access to the service, in the event of a force majeure, computer breakdowns, and disruption or strikes affecting, directly or indirectly, communication services.

6. RETURNS

The Observatory cannot accept any returns or cancellation of orders for services that have been made available electronically.

7. PROTECTION OF PERSONAL DATA

The Observatory undertakes not to pass on any client’s personal data to third parties; these are confidential and will be used only for the processing of orders and their payment in collaboration with the invoicing software company and the banks involved, and to communicate electronically any offers on Observatory products and services.

The client may choose at any time to have his/her name removed from the Observatory's mailing list or to have his/her account deleted from the Observatory’s client database by sending a request using the contact form on the website. All clients may also modify their personal details at any time using the function "My account".

8. LIABILITY

The Observatory provides all data and other information to the Subscriber on an “AS IS” and “AS AVAILABLE” basis without representations, agreements or warranties of any kind, express or implied, either in fact or by operation of law, statutory or otherwise, including but not limited to warranties of merchantability or fitness for a particular purpose. The Observatory will make all efforts in order to offer the best quality of services.

The Subscriber recognizes that data and other information provided through the Yearbook are compiled from materials furnished to the Observatory by outside sources and should be used as a reference source only. The Observatory and its third party sources do not guarantee that the provided data, services or other information will be free of errors, omissions or other inaccuracies. The Observatory does not guarantee that the Subscriber's use of the Yearbook, including but not limited to, access to the data, the functioning of the search tools and other software and documentation, will be uninterrupted or error-free, or that the results obtained will be successful or will satisfy the Subscriber’s requirements.

In no event shall the Observatory, its employees or its third party sources be liable under a theory, including but not limited to contract, breach of warranty, tort (including negligence) or product liability, for any direct, indirect, incidental, special or consequential damages (including, without limitation, any loss of profits or data, business interruption, or other pecuniary loss) arising from or relating to the use of or inability to use the Yearbook data and services, even if the Observatory has been notified of the possibility of such damages. The Subscriber assumes the sole responsibility for its use of the data, information and services provided under his/her subscription. In no event will the Observatory´s liability or that of its third party providers exceed the subscription fee paid by the Subscriber during the immediately preceding 12 month period under his/her subscription.

9. USE AND CONFIDENTIALITY

All products and services purchased from the Observatory as part of its publications, databases and information services, are confidential and made available for the purchasing client only. The client has no right to transmit products and services purchased from the Observatory to any third party and must take all necessary precautions to ensure that no unauthorised person can access this content.

Access codes to the Observatory Yearbook Online Service shall not be communicated to any third party. Third parties in this context are all persons who are not employees of the purchasing company/organisation. In case of a single user licence, the access codes may also not be communicated to employees within the purchasing company/organisation.

10. INTELLECTUAL PROPERTY RIGHTS AND REPRODUCTION

All content included in or made available through any Observatory service, including text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of the Observatory or its content suppliers.

The Subscriber will take any and all actions that may reasonably be required by the Observatory to protect the intellectual property rights.

The Subscriber acknowledges that his subscription does not lead to any ownership of data or other intellectual property rights in relation to any of the data or other information provided through the Yearbook or the Observatory. The Subscriber does not have and shall not claim to have, any right in any of the data or other information documentation received from the Observatory.

The Subscriber acknowledges that all material (such as training materials or technical information), delivered through the Yearbook are under the property and/or copyright of the Observatory or some other person or entity that holds copyright in the information used.

Subscribers may only quote individual data from the Yearbook in presentations or reports, mentioning the source “© European Audiovisual Observatory” or “© Observatoire européen de l'audiovisuel” or “© Europäische Audiovisuelle Informationsstelle”.

The reproduction of a full table or a graph from the Yearbook in a public presentation, reports or web pages requires the explicit authorisation of the European Audiovisual Observatory. The European Audiovisual Observatory can only authorise reproduction of tables or graphs sourced as “European Audiovisual Observatory”. All other entries may only be reproduced with the consent of the original source.

11. APPLICABLE LAW - DISPUTES

11.1. Any dispute relating to the execution or application of a contract covered by Article 21 of the General Agreement on privileges and immunities of the Council of Europe shall be submitted, failing a friendly settlement between the parties, for decision to an Arbitration Board composed of two arbitrators, each selected by one of the parties, and a presiding arbitrator, appointed by the other two arbitrators; in the event of no presiding arbitrator being appointed under the above conditions within a period of six months, the President of the Tribunal de Grande Instance de Strasbourg shall make the appointment.

For the avoidance of doubt, it is clarified that any action relating to the infringement of any rights to the content of the Yearbook Online Service (e.g. under copyright, trade secret, or unfair competition or contractual protection) shall not be considered as a dispute relating to the execution or application of the contract.

11.2. However, the parties may submit the dispute for decision to a single arbitrator selected by them by common agreement or, failing such agreement, by the President of the Tribunal de Grande Instance de Strasbourg.

11.3. The Board referred to in Article 1 or, where appropriate, the arbitrator referred to in Article 2 shall determine the procedure to be followed.

11.4. If the parties do not agree on the law applicable, the Board or, where appropriate, the arbitrator, shall decide ex æquo et bono having regard to the general principles of law and to commercial usage.

11.5. The arbitral decision shall be binding upon the two parties and there shall be no appeal from it.

Les informations publiées sur ce site ne constituent pas un avis professionnel ou juridique de l'Observatoire, du Conseil de l'Europe ou de toute autre organisation, entité ou personne contribuant à notre site internet.

L'Observatoire est attaché au respect de la vie privée. Sa politique en matière de protection des données à caractère personnel se fonde sur le Règlement du Secrétaire Général du 17 avril 1989 instaurant un système de protection des données pour les fichiers de données à caractère personnel du Conseil de l’Europe.

Lorsqu’un utilisateur se connecte sur le site, certains renseignements le concernant, tels que son adresse numérique Internet (IP), sa navigation sur le site, les logiciels utilisés, le temps passé et d’autres données de même nature, sont stockées sur les serveurs du Conseil de l'Europe. Conditions générales

1. COMMANDES

En passant commande à l’Observatoire d’une publication ou d’un service d’information, le client accepte les conditions générales d’utilisation et de vente établies ci-dessous.

Le client peut utiliser ce site web pour commander l’Annuaire service en ligne. La procédure de commande comprend plusieurs étapes qui sont validées successivement. La validation finale intervient à la fin de la procédure de commande. Le client peut décider d’annuler sa commande à toute étape de la procédure. Il est également possible de passer commande par lettre ou e-mail :

L’Observatoire se réserve le droit d’annuler ou de refuser toute commande d’un client avec lequel il existe un litige relatif à un achat antérieur.

2. PRIX

Les prix sont en euros et unitaires. Les prix appliqués à toute commande sont ceux en vigueur à la date de la commande.

3. TVA

Les prix de tous les produits de l’Observatoire européen de l’audiovisuel s’entendent hors droits et taxes. Il appartient au client de contacter les services fiscaux et douaniers pour acquitter tout droit ou taxe. En raison de son statut d’Accord partiel du Conseil de l’Europe, organisation internationale, l’Observatoire ne dispose pas de numéro d’identification de TVA intra-communautaire et n’applique pas de taxe sur la valeur ajoutée (TVA).

4. CONDITIONS DE RÈGLEMENT

Le paiement est exigible au moment de la commande. Le paiement doit être effectué en euros par l’une des méthodes suivantes :

  • Carte de crédit – L’Observatoire n’accepte que les cartes Visa et MasterCard. Les cartes délivrées hors de France doivent obligatoirement être des cartes bancaires internationales. Le paiement électronique par carte bancaire proposé sur ce site présente toutes les garanties de sécurité grâce au chiffrement des données au moyen du protocole SSL (Secure Socket Layer). Toutes les informations transmises sont codées et ne peuvent être lues au cours du transport sur le réseau Internet. L’Observatoire ne conserve aucune donnée des cartes de crédit.
  • Virement bancaire – Le client effectuant le virement bancaire prend à sa charge tous les frais bancaires relatifs à son paiement. Les coordonnées bancaires de l’Observatoire (IBAN, BIC...) sont communiquées au client lors de la confirmation de sa commande.

5. ACCÈS AUX SERVICES EN LIGNE

L’accès à l'Annuaire service en ligne est exclusivement réservé aux abonnés. Il est strictement interdit aux abonnés de communiquer leur code d’accès à une tierce personne.

Les services en ligne sont mis à disposition dès leur règlement. L'Observatoire s'engage à traiter rapidement toute commande après réception du paiement correspondant. Une fois le paiement validé, le client sera averti par courriel de ses codes d'accès à l'Annuaire service en ligne.

L’Observatoire garantit l’accès à l’Annuaire service en ligne au moins jusqu’à la fin de la deuxième année civile suivant l’année couverte par l’Annuaire (par exemple : l’Annuaire service en ligne 2017 est accessible au moins jusqu’à la fin 2019). Il appartient au client de télécharger le produit ou le service acheté s’il souhaite pouvoir y accéder après cette période.

L'Observatoire ne peut être tenu responsable des conséquences d'un retard dans le traitement des commandes ou d'un retard ou d'une interruption dans l'accès au service, en cas de force majeure, d’incidents informatiques, de perturbations ou de grèves affectant, directement ou indirectement, les services de communication.

6. RETOURS

L’Observatoire ne peut accepter aucun retour ou annulation de commande pour des services qui ont été mis à disposition par voie électronique.

7. PROTECTION DES DONNÉES PERSONNELLES

L’Observatoire s’engage à ne pas divulguer à des tiers les données personnelles de ses clients ; ces informations sont confidentielles et ne seront utilisées que pour le traitement et le paiement des commandes avec l’appui de la société du logiciel de facturation et les banques concernées, ainsi que pour communiquer, par voie électronique, toute offre concernant les produits et services de l’Observatoire.

Le client peut à tout moment faire retirer son nom de la liste de diffusion de l’Observatoire ou faire supprimer son compte de la base de données clients de l’Observatoire en envoyant sa demande par l’intermédiaire du formulaire de contact disponible sur le site web. Les clients peuvent également modifier leurs données personnelles à tout moment en utilisant la fonction « Mon compte ».

8. RESPONSABILITÉ

L’Observatoire fournit toutes les données et autres informations à l’Abonné sur une base « EN L'ÉTAT » ou « TELLE QUE DISPONIBLE » sans déclaration, accord ou garantie d’aucune sorte, exprès ou implicite, en fait ou en droit, réglementaire ou autre, y compris, sans que cela soit limitatif, les garanties de commercialisation ou de conformité à un usage particulier. L’Observatoire fera tout son possible pour offrir la meilleure qualité de services.

L’Abonné reconnaît que les données et autres informations communiquées par l’intermédiaire de l’Annuaire sont compilées à partir de matériaux fournis à l’Observatoire par des sources extérieures et ne doivent être utilisées qu’à titre de référence. L’Observatoire et ses sources tierces ne garantissent pas que les données, services ou autres informations fournis soient exempts d’erreurs, d’omissions ou d’autres inexactitudes. L’Observatoire ne garantit pas que l’utilisation de l’Annuaire par l’Abonné, y compris, sans que cela soit limitatif, l’accès aux données, le fonctionnement des outils de recherche et d’autres logiciels et documentations, sera ininterrompue ou exempte d’erreurs, ni que les résultats obtenus seront pertinents ou répondront aux exigences de l’Abonné.

En aucun cas l’Observatoire, ses employés ou ses sources tierces ne seront tenus responsables en vertu d’une disposition, y compris, sans que cela soit limitatif, en vertu d’un contrat, d’une rupture de garantie, d’un préjudice (y compris la négligence) ou de la responsabilité du fait des produits, pour tout dommage direct, indirect, accessoire, spécial ou consécutif (y compris, sans que cela soit limitatif, toute perte de profits ou de données, toute interruption d’activité ou toute autre perte financière) découlant de l’utilisation ou de l’incapacité d’utiliser les données et les services de l’Annuaire ou s’y rapportant, même si l’Observatoire a été informé de la possibilité de tels dommages. L’Abonné assume l’entière responsabilité de son utilisation des données, informations et services fournis dans le cadre de son abonnement. En aucun cas la responsabilité de l’Observatoire ou de ses fournisseurs tiers ne dépassera les frais d’abonnement payés par l’Abonné au cours des 12 mois précédant immédiatement sa souscription.

9. UTILISATION ET CONFIDENTIALITÉ

Tous les produits et services achetés à l’Observatoire dans le cadre de ses publications, bases de données et services d’information, sont confidentiels et uniquement mis à la disposition du client acheteur. Le client n’a aucun droit de transmettre les produits et services achetés auprès de l’Observatoire à un quelconque tiers et doit prendre toutes les précautions nécessaires pour s’assurer qu’aucune personne non autorisée ne puisse accéder à ce contenu.

Les codes d’accès au service en ligne de l’Annuaire ne peuvent être communiqués à des tiers. Dans ce contexte, les tiers sont toutes les personnes qui ne sont pas des employés de l’entreprise/organisation ayant effectué l’achat. Dans le cas d'une licence d'utilisateur unique, les codes d'accès ne peuvent pas non plus être communiqués aux employés de la société/organisation ayant effectué l’achat.

10. DROIT DE PROPRIÉTÉ INTELLECTUELLE ET REPRODUCTION

Tout le contenu inclus dans, ou mis à disposition par le biais de tout service de l’Observatoire, y compris les textes, graphiques, logos, boutons icônes, images, audioclips, téléchargements numériques et compilations de données, est la propriété de l’Observatoire ou de ses fournisseurs de contenu.

L’Abonné prendra toutes mesures pouvant être raisonnablement exigées par l’Observatoire pour protéger les droits de propriété intellectuelle.

L’Abonné reconnaît que son abonnement ne lui donne aucun droit de propriété sur les données ou autres droits de propriété intellectuelle relatifs à toute donnée ou autre information communiquée par l’intermédiaire de l’Annuaire ou de l’Observatoire. L’abonné n’a pas et ne peut prétendre avoir, un quelconque droit sur les données ou autres informations communiquées par l’Observatoire.

L’Abonné reconnaît que l’Observatoire ou toute autre personne ou entité titulaire du droit d’auteur sur les informations utilisées possède et/ou détient le droit d’auteur sur tout matériel (tel que matériaux de formation ou informations techniques), mis à disposition par l’intermédiaire de l’Annuaire.

Les abonnés peuvent seulement citer des données individuelles de l’Annuaire dans des présentations ou des rapports, en mentionnant la source « © European Audiovisual Observatory » ou « © Observatoire européen de l’audiovisuel » ou « ©Europäische Audiovisuelle Informationsstelle ».

La reproduction d’un tableau dans son intégralité ou d’un graphique de l’Annuaire dans une présentation publique, dans des rapports ou des pages web est soumise à l’autorisation expresse de l’Observatoire européen de l’audiovisuel. L’Observatoire européen de l’audiovisuel ne peut autoriser que la reproduction des tableaux et graphiques référencés avec la mention « Source : Observatoire européen de l’audiovisuel ». La reproduction de tout autre tableau et graphique ne peut être effectuée qu’avec l’autorisation préalable des sources originales.

11. DROIT APPLICABLE - LITIGES

11.1. Tout différend lié à l’exécution ou à l’application d’un contrat entrant dans le champ d’application de l’article 21 de l’Accord général sur les privilèges et immunités du Conseil de l’Europe sera soumis, à défaut d’un règlement amiable entre les parties, à la décision d’un conseil arbitral constitué de deux arbitres, respectivement choisis par chacune des parties, et d’un président désigné par les deux arbitres. Si le président ne peut pas être désigné selon les conditions qui précèdent dans un délai de six mois c’est le Président du Tribunal de Grande Instance de Strasbourg qui procédera à sa désignation.

Pour prévenir toute incertitude, il est précisé que toute action relative à la violation de tout droit sur le contenu du service en ligne de l’Annuaire (par exemple au titre du droit d’auteur, du secret commercial, de la concurrence déloyale ou de la protection contractuelle) ne sera pas considérée comme un différend relatif à l’exécution ou à l’application du contrat.

11.2. Les parties pourront toutefois soumettre leur différend à la décision d’un arbitre unique qu’elles auront choisi d’un commun accord ou, à défaut d’un tel accord, qui aura été choisi par le Président du Tribunal de Grande Instance de Strasbourg.

11.3. Le conseil arbitral visé à l’article 1er ou, le cas échéant, l’arbitre visé à l’article 2 déterminera la procédure à suivre.

11.4. Si les parties ne s’entendent pas sur la loi applicable, le conseil arbitral ou, le cas échéant, l’arbitre, rendra sa décision ex æquo et bono en tenant compte des principes généraux du droit et des usages commerciaux.

11.5. La décision arbitrale liera les deux parties et ne pourra faire l’objet d’aucun appel.

1. BESTELLUNGEN

Mit der Bestellung von Informationsdiensten oder Publikationen der Informationsstelle erkennt der Kunde die nachstehenden Nutzungs- und Verkaufsbedingungen an. Der Kunde kann zur Bestellung des Jahrbuch-Online-Service diese Website nutzen. Der Bestellvorgang besteht aus verschiedenen Schritten, die nacheinander bestätigt werden. Die endgültige Bestätigung erfolgt am Ende des Bestellvorgangs. Der Kunde kann sich in jedem Bestellschritt für den Abbruch der Bestellung entscheiden. Bestellungen können auch per Brief oder E-Mail vorgenommen werden:

Die Informationsstelle behält sich das Recht vor, Bestellungen eines Kunden, mit dem ein Rechtsstreit bezüglich einer früheren Bestellung besteht, zu stornieren oder abzulehnen.

2. PREISE

Die Preise sind in Euro und pro Stück angegeben. Bei allen Bestellungen gelten die am Bestelltag gültigen Preise.

3. MEHRWERTSTEUER

Sämtliche Produktpreise der Europäischen Audiovisuellen Informationsstelle verstehen sich zuzüglich Steuern und Abgaben. Es obliegt dem Kunde, sich bei den Finanz- oder Zollbehörden zu melden, um die entsprechenden Steuern und Abgaben abzuführen. Aufgrund ihres Status als Teilabkommen des Europarates, einer internationalen Organisation, verfügt die Informationsstelle nicht über eine innergemeinschaftliche Umsatzsteuer-Identifikationsnummer und erhebt keine Mehrwertsteuer (MwSt.).

4. ZAHLUNGSBEDINGUNGEN

Zahlungen werden mit der Bestellung fällig. Die Zahlung muss in Euro erfolgen. Dabei stehen folgende Zahlungsarten zur Verfügung:

  • Kreditkarte – Die Informationsstelle akzeptiert ausschließlich Visa und MasterCard. Außerhalb von Frankreich ausgegebene Karten müssen internationale Bankkarten sein. Das auf dieser Website für die elektronische Zahlung per Kreditkarte bereitgestellte System ist durch Datenverschlüsselung mittels SSL-Protokoll (Secure Socket Layer) vollständig geschützt. Alle übertragenen Daten werden verschlüsselt und können während des Transfers im Internet nicht gelesen werden. Die Informationsstelle speichert keine Kreditkartendaten.
  • Banküberweisung – Der Kunde, der die Banküberweisung vornimmt, trägt die im Zusammenhang mit der Zahlung anfallenden Bankgebühren. Die Bankverbindung der Informationsstelle (IBAN, BIC, ...) wird dem Kunden nach Bestätigung der Bestellung mitgeteilt.

5. ZUGANG ZU ONLINE-DIENSTEN

Der Zugang zur Datenbank ist ausschließlich Abonnenten vorbehalten. Abonnenten dürfen den Zugangscode nicht an Dritte weitergeben.

Online-Dienste werden nach der Zahlung bereitgestellt. Die Informationsstelle wird alle Bestellungen nach Eingang der entsprechenden Zahlung zügig bearbeiten. Sobald die Zahlung des Kunden bestätigt ist, wird der Kunde per E-Mail benachrichtigt. Die Nachricht enthält den Link zum persönlichen Bereich, in dem der Online-Dienst vom Kunden abgerufen werden kann.

Die Informationsstelle gewährleistet den Zugang zum Jahrbuch-Online-Service mindestens bis zum Ablauf des zweiten Kalenderjahrs, das dem Jahr folgt, auf das sich das Jahrbuch bezieht (z. B. ist der Jahrbuch-Online-Service 2017 mindestens bis Ende 2019 verfügbar). Es obliegt dem Kunden, das erworbene Produkt oder den bezogenen Dienst herunterzuladen, falls er den Zugang auch nach diesem Zeitraum sicherstellen möchte.

Die Informationsstelle haftet nicht für die Folgen einer Verzögerung bei der Bearbeitung von Bestellungen oder einer Verzögerung oder Unterbrechung bei der Bereitstellung des Zugangs zu Diensten, im Falle höherer Gewalt, bei Computerausfällen sowie bei Störungen oder Streiks, die direkt oder indirekt die Kommunikationsdienste beeinträchtigen.

6. RETOUREN

Die Informationsstelle kann keine Retouren oder Stornierungen von Bestellungen für Dienste entgegennehmen, die auf elektronischem Weg zur Verfügung gestellt wurden.

7. SCHUTZ PERSONENBEZOGENER DATEN

Die Informationsstelle verpflichtet sich, keine personenbezogenen Daten des Kunden an Dritte weiterzugeben; diese sind vertraulich und werden ausschließlich zur Bearbeitung von Bestellungen und deren Bezahlung in Zusammenarbeit mit dem Unternehmen, das die Abrechnungssoftware bereitstellt, und den beteiligten Banken sowie zur auf elektronischem Weg erfolgenden Unterbreitung von Angeboten zu Produkten und Diensten der Informationsstelle verwendet.

Der Kunde kann sich jederzeit dazu entscheiden, seinen Namen aus dem Verteiler der Informationsstelle entfernen zu lassen oder sein Konto aus der Kundendatenbank der Informationsstelle zu löschen, indem er über das Kontaktformular auf der Website eine entsprechende Aufforderung versendet. Alle Kunden haben mittels der Funktion „Mein Konto“ auch jederzeit die Möglichkeit, ihre personenbezogenen Daten zu ändern.

8. HAFTUNG

Die Informationsstelle stellt dem Abonnenten alle Daten und sonstigen Informationen „WIE VORHANDEN“ und „WIE VERFÜGBAR“ bereit, ohne irgendwelche ausdrücklichen oder stillschweigenden Zusicherungen, Vereinbarungen oder Gewährleistungen, die entweder tatsächlich oder kraft gesetzlichen oder sonstigen Rechts bestehen, einschließlich aber nicht beschränkt auf Gewährleistung der Marktgängigkeit oder Eignung für einen bestimmten Zweck. Die Informationsstelle unternimmt alle Anstrengungen, Dienste von bester Qualität zu erbringen.

Der Abonnent erkennt an, dass die mit dem Jahrbuch angebotenen Daten und sonstigen Informationen aus Materialien zusammengestellt sind, die der Informationsstelle von externen Quellen bereitgestellt werden, und lediglich als Referenzquelle genutzt werden sollten. Die Informationsstelle und ihre Drittquellen geben keine Gewähr, dass die bereitgestellten Daten, Dienste oder sonstigen Informationen keine Irrtümer, Lücken oder sonstige Ungenauigkeiten enthalten. Die Informationsstelle gibt keine Gewähr, dass die Nutzung des Jahrbuchs durch den Abonnenten, einschließlich aber nicht beschränkt auf den Zugang zu Daten, die Funktionsfähigkeit der Suchwerkzeuge und sonstiger Software und Dokumentation, unterbrechungsfrei oder fehlerfrei erfolgt oder dass die gewonnenen Erkenntnisse nutzbringend sein oder den Anforderungen des Abonnenten entsprechen werden.

Die Informationsstelle, ihre Mitarbeiter oder Drittquellen haften nicht wegen Vertragsbruch, Gewährleistungsbruch, unerlaubter Handlungen (einschließlich Fahrlässigkeit), Produkthaftung oder aufgrund einer anderen Anspruchsgrundlage für direkte, indirekte, zufällige, besondere oder Folgeschäden (unbeschränkt einschließlich jeglichen entgangenen Gewinns oder Datenverlusts, Geschäftsunterbrechung oder sonstiger Vermögensschäden) aufgrund oder im Zusammenhang mit der Nutzung oder nicht möglichen Nutzung der Jahrbuch-Daten und Dienste, selbst wenn der Informationsstelle die Möglichkeit solcher Schäden angezeigt wurde. Der Abonnent trägt die alleinige Verantwortung für die Nutzung der Daten, Informationen und Dienste, die im Rahmen seines Abonnements angeboten werden. Die Haftung der Informationsstelle oder die ihrer Drittlieferanten ist in jedem Fall auf die Abonnementgebühr begrenzt, die vom Abonnenten während des unmittelbar vorausgegangenen Zwölfmonatszeitraums seines Abonnements entrichtet wurde.

9. NUTZUNG UND VERTRAULICHKEIT

Sämtliche bei der Informationsstelle als Teil ihrer Publikationen, Datenbanken und Informationsdienste erworbenen Produkte und Dienste sind vertraulich und werden ausschließlich dem sie erwerbenden Kunden zur Verfügung gestellt. Der Kunde ist nicht berechtigt, die von der Informationsstelle erworbenen Produkte und Dienste an Dritte weiterzuleiten, und muss alle notwendigen Vorkehrungen treffen, um sicherzustellen, dass kein Unbefugter auf diese Inhalte zugreifen kann.

Zugangsdaten zu dem Jahrbuch-Online-Service dürfen Dritten nicht bekannt gegeben werden. Als Dritte gelten in diesem Zusammenhang alle Personen, die keine Mitarbeiter des erwerbenden Unternehmens/der erwerbenden Organisation sind. Im Falle einer Einzelnutzerlizenz, dürfen Zugangsdaten auch nicht an Mitarbeiter des erwerbenden Unternehmens/der erwerbenden Organisation weitergegeben werden.

10. RECHTE DES GEISTIGEN EIGENTUMS UND VERVIELFÄLTIGUNG

Sämtliche in den Diensten der Informationsstelle enthaltenen oder durch diese zur Verfügung gestellten Inhalte, darunter Texte, Grafiken, Logos, Schaltflächensymbole, Bilder, Audioclips, digitale Downloads und Datensammlungen, sind Eigentum der Informationsstelle oder ihrer Inhalteanbieter.

Der Abonnent ergreift alle Maßnahmen, die die Informationsstelle vernünftigerweise verlangen kann, um die Rechte des geistigen Eigentums zu schützen.

Der Abonnent erkennt an, dass sein Abonnement keinerlei Eigentum an Daten oder sonstigen Rechten des geistigen Eigentums in Bezug auf die Daten oder sonstigen Informationen begründet, die durch das Jahrbuch oder die Informationsstelle bereitgestellt wurden. Der Abonnent hat keinerlei Rechte an den Daten oder sonstigen von der Informationsstelle empfangenen Informationen/Dokumenten und kann keine solche Rechte geltend machen.

Der Abonnent erkennt an, dass jegliches durch das Jahrbuch bereitgestelltes Material (wie Schulungsmaterial oder technische Informationen) dem Eigentum und/oder dem Urheberrecht der Informationsstelle oder einer sonstigen Person oder Körperschaft, die Urheberrechte an den genutzten Informationen hat, unterliegt.

Abonnenten dürfen einzelne Daten aus dem Jahrbuch in Präsentationen oder Berichten nur unter Angabe der Quelle „© European Audiovisual Observatory“ oder „© Observatoire européen de l'audiovisuel“ oder „© Europäische Audiovisuelle Informationsstelle“ zitieren.

Die Vervielfältigung einer ganzen Tabelle oder einer Abbildung aus dem Jahrbuch in einer öffentlichen Präsentation oder in Berichten oder auf Webseiten bedarf der ausdrücklichen Genehmigung der Europäischen Audiovisuellen Informationsstelle. Die Europäische Audiovisuelle Informationsstelle kann nur die Reproduktion der Tabellen oder Abbildungen gestatten, die mit „Quelle: Europäische Audiovisuelle Informationsstelle” gekennzeichnet sind, . Alle anderen Einträge können nur im Einverständnis mit der Originalquelle reproduziert werden.

Genehmigungen sind hier einzuholen.

11. ANWENDBARES RECHT – RECHTSSTREITIGKEITEN

11.1. Streitigkeiten in Zusammenhang mit der Ausführung oder Anwendung eines unter Artikel 21 des Allgemeinen Abkommens über die Vorrechte und Befreiungen des Europarates fallenden Vertrags werden, sofern es zu keiner einvernehmlichen Streitbeilegung zwischen den Parteien kommt, einem Schiedsgericht zur Entscheidung vorgelegt. Dieses besteht aus zwei Schiedsrichtern, von denen je einer von einer der Parteien bestellt wird, sowie einem vorsitzenden Schiedsrichter, der von den beiden anderen Schiedsrichtern ernannt wird; falls innerhalb von sechs Monaten unter den oben genannten Bedingungen kein vorsitzender Schiedsrichter ernannt wird, nimmt der Präsident des Tribunal de Grande Instance de Strasbourg die Ernennung vor.

Um Zweifel auszuschließen wird klargestellt, dass Maßnahmen im Zusammenhang mit der Verletzung von Rechten an Inhalten des Jahrbuch-Onlinedienstes (z. B. aus Urheberrecht, Geheimnisschutz, unlauterem Wettbewerb oder vertraglich eingeräumtem Schutz) nicht als Streitigkeiten im Zusammenhang mit der Ausführung oder Anwendung des Vertrages gelten.

11.2. Allerdings können die Parteien die Streitigkeit einem einzelnen Schiedsrichter zur Entscheidung vorlegen, der im gegenseitigen Einvernehmen der Parteien oder, mangels eines derartigen Einvernehmens, vom Präsidenten des Tribunal de Grande Instance de Strasbourg bestellt wird.

11.3. Das in Artikel 1 genannte Schiedsgericht oder gegebenenfalls der in Artikel 2 genannte Schiedsrichter legen das zu befolgende Verfahren fest.

11.4. Können sich die Parteien nicht auf das anwendbare Recht einigen, entscheidet das Schiedsgericht oder gegebenenfalls der Schiedsrichter ex aequo et bono unter Berücksichtigung allgemeiner Rechtsgrundsätze und des Handelsbrauchs.

11.5. Die schiedsrichterliche Entscheidung ist für die beiden Parteien bindend und nicht anfechtbar.
