Please note that the general terms and conditions for purchasing access to our Yearbook contain parts relevant to the use of the Yearbook. They are available under “Legal Mentions”.
1. THE YEARBOOK
The Yearbook provides a wide range of statistical data on the four main industry branches of the audiovisual sector in Europe: the film industry, television and video/DVD and on-demand audiovisual services. The figures are available in Excel tables and graphs, the text in PDF version. The Yearbook provides three sub-sets of data:
- the access to detailed tables and figures,
- the access to country profiles,
- the access to the Yearbook Key trends report.
The Yearbook data are delivered progressively, based on the availability of data. As a subscriber you will be informed via the Yearbook web site of the availability of data.
2. ACCESS AND USE
Access to the database is exclusively reserved for subscribers. Subscribers shall not communicate the access code to any third person.
All data accessed or downloaded from the Yearbook must be kept confidential and shall not be communicated to anyone outside the subscribing company/organisation. Clients commit themselves to take all necessary precautions to avoid non authorised reproduction and dissemination of the data received.
3. INTELLECTUAL PROPERTY RIGHTS
All data provided are under the copyright of the various producers of the information and/or the Observatory.
The Subscriber will take any and all action that may reasonably be required by the Observatory to protect the intellectual property rights.
The Subscriber acknowledges that his subscription does not lead to any ownership of data or other intellectual property rights in relation to any of the data or other information provided through the Yearbook or the Observatory. The Subscriber does not have and shall not claim to have, any right in any of the data or other information documentation received from the Observatory.
The Subscriber acknowledges that all material (such as training materials or technical information), delivered through the Yearbook are under the property and/or copyright of the Observatory or some other person or entity that holds copyright in the information used.
4. LIMITATION OF LIABILITY
The Observatory provides all data and other information to the Subscriber on an “AS IS” and “AS AVAILABLE” basis without representations, agreements or warranties of any kind, express or implied, either in fact or by operation of law, statutory or otherwise, including but not limited to warranties of merchantability or fitness for a particular purpose. The Observatory will make all efforts in order to offer the best quality of services.
The Subscriber recognizes that data and other information provided through the Yearbook are compiled from materials furnished to the Observatory by outside sources and should be used as a reference source only. The Observatory and its third party sources do not guarantee that the provided data, services or other information will be free of errors, omissions or other inaccuracies. The Observatory does not guarantee that the Subscriber's use of the Yearbook , including but not limited to, access to the data, the functioning of the search tools and other software and documentation, will be uninterrupted or error-free, or that the results obtained will be successful or will satisfy the Subscriber’s requirements.
In no event shall the Observatory, its employees or its third party sources be liable under a theory, including but not limited to contract, breach of warranty, tort (including negligence) or product liability, for any direct, indirect, incidental, special or consequential damages (including without limitation any loss of profits or data, business interruption, or other pecuniary loss) arising from or relating to the use of or inability to use the Yearbook data and services, even if the Observatory has been notified of the possibility of such damages. The Subscriber assumes the sole responsibility for its use of the data, information and services provided under his subscription. In no event will the Observatory´s liability or that of its third party providers exceed the subscription fee paid by the Subscriber during the immediately preceding 12 month period under his subscription.
5. QUOTING AND REPRODUCTION OF CONTENT FROM THE YEARBOOK
Subscribers may only quote individual data from the Yearbook in presentations or reports, mentioning the source “© European Audiovisual Observatory” or “© Observatoire européen de l'audiovisuel” or “© Europäische Audiovisuelle Informationsstelle”.
The reproduction of a full table or a graph from the Yearbook in a public presentations, reports or web pages requires the explicit authorisation of the European Audiovisual Observatory. Please note that the European Audiovisual Observatory can only authorise reproduction of tables or graphs sourced as “European Audiovisual Observatory”. All other entries may only be reproduced with the consent of the original source.

1. L’ANNUAIRE
L’Annuaire fournit un large éventail de données statistiques sur les quatre principales branches du secteur audiovisuel en Europe : l’industrie cinématographique, la télévision, la vidéo/les DVD et les services audiovisuels à la demande. Les chiffres sont disponibles sous forme de tableaux Excel et de graphiques, le texte est disponible en version PDF. L’Annuaire comprend trois sous-ensembles de données :
- l’accès à des tableaux et chiffres détaillés,
- l’accès au profil des pays,
- l’accès au rapport sur les tendances clés de l’Annuaire.
Les données de l’Annuaire sont mises en ligne progressivement, en fonction de leur disponibilité. En tant qu’abonné, vous êtes informé de la disponibilité des données par l’intermédiaire du site internet de l’Annuaire.
2. ACCES ET UTILISATION
L’accès à la base de données est exclusivement réservé aux abonnés. Il est strictement interdit aux abonnés de communiquer le code d’accès à une tierce personne.
Toutes les données consultées ou téléchargées à partir de l’Annuaire doivent rester confidentielles et ne peuvent être communiquées à quiconque en dehors de la société/l’organisation bénéficiant de l’abonnement. Les clients s’engagent à prendre toutes les précautions nécessaires pour éviter la reproduction et la diffusion non autorisées des données reçues.
3. DROITS DE PROPRIÉTÉ INTELLECTUELLE
Le droit d’auteur des différents producteurs d’informations et/ou de l’Observatoire s’appliquent à toutes les données fournies.
L’Abonné prendra toute mesure pouvant être raisonnablement exigée par l’Observatoire pour protéger les droits de propriété intellectuelle.
L’Abonné reconnaît que son abonnement ne lui donne aucun droit de propriété sur les données ou autres droits de propriété intellectuelle relatifs à toute donnée ou autre information communiquée par l’intermédiaire de l’Annuaire ou de l’Observatoire. L’abonné n’a pas et ne peut prétendre avoir un quelconque droit sur les données ou autres informations communiquées par l’Observatoire.
L’Abonné reconnaît que l’Observatoire ou toute autre personne ou entité titulaire du droit d’auteur sur les informations utilisées possède et/ou détient le droit d’auteur sur tout matériel (tel que matériaux de formation ou informations techniques), mis à disposition par l’intermédiaire de l’Annuaire.
4. LIMITATION DE RESPONSABILITÉ
L’Observatoire fournit toutes les données et autres informations à l’Abonné sur une base « EN L'ÉTAT » ou « TEL QUE DISPONIBLE » sans déclaration, accord ou garantie d’aucune sorte, exprès ou implicite, en fait ou en droit, réglementaire ou autre, y compris, sans que cela soit limitatif, les garanties de commercialisation ou de conformité à un usage particulier. L’Observatoire fera tout son possible pour offrir la meilleure qualité de services.
L’Abonné reconnaît que les données et autres informations communiquées par l’intermédiaire de l’Annuaire sont compilées à partir de matériaux fournis à l’Observatoire par des sources extérieures et ne doivent être utilisées qu’à titre de référence. L’Observatoire et ses sources tierces ne garantissent pas que les données, services ou autres informations fournis soient exempts d’erreurs, d’omissions ou d’autres inexactitudes. L’Observatoire ne garantit pas que l’utilisation de l’Annuaire par l’Abonné, y compris, sans que cela soit limitatif, l’accès aux données, le fonctionnement des outils de recherche et d’autres logiciels et documentations, sera ininterrompue ou exempte d’erreurs, ni que les résultats obtenus seront pertinents ou répondront aux exigences de l’Abonné.
En aucun cas l’Observatoire, ses employés ou ses sources tierces ne seront tenus responsables en vertu d’une disposition (y compris, sans que cela soit limitatif, en vertu d’un contrat), d’une rupture de garantie, d’un préjudice (y compris la négligence) ou de la responsabilité du fait des produits, pour tout dommage direct, indirect, accessoire, spécial ou consécutif (y compris, sans que cela soit limitatif, toute perte de profits ou de données, toute interruption d’activité ou toute autre perte financière) découlant de l’utilisation ou de l’incapacité d’utiliser les données et les services de l’Annuaire ou s’y rapportant, même si l’Observatoire a été informé de la possibilité de tels dommages. L’Abonné assume l’entière responsabilité de son utilisation des données, informations et services fournis dans le cadre de son abonnement. En aucun cas la responsabilité de l’Observatoire ou de ses fournisseurs tiers ne dépassera les frais d’abonnement payés par l’Abonné au cours des 12 mois précédant immédiatement sa souscription.
5. CITATION ET REPRODUCTION DU CONTENU DE L’ANNUAIRE
Les abonnés peuvent seulement citer des données individuelles de l’Annuaire dans des présentations ou des rapports, en mentionnant la source « © European Audiovisual Observatory » ou « © Observatoire européen de l’audiovisuel » ou « © Europäische Audiovisuelle Informationsstelle ».
La reproduction d’un tableau dans son intégralité ou d’un graphique de l’Annuaire dans une présentation publique, dans des rapports ou des pages web est soumise à l’autorisation expresse de l’Observatoire européen de l’audiovisuel. L’Observatoire européen de l’audiovisuel ne peut autoriser que la reproduction des tableaux et graphiques référencés avec la mention « Source : Observatoire européen de l’audiovisuel ». La reproduction de tout autre tableau et graphique ne peut être effectuée qu’avec l’autorisation préalable des sources originales.

Die Daten des Jahrbuchs werden nach Verfügbarkeit sukzessive zur Verfügung gestellt. Als Abonnent informieren wir Sie über die Jahrbuch-Website über die Verfügbarkeit von Daten.
2. NUTZUNGSBEDINGUNGEN
Der Zugang zur Datenbank ist ausschließlich Abonnenten vorbehalten. Abonnenten dürfen den Zugangscode nicht an Dritte weitergeben.
Alle Daten des Jahrbuchs, auf die zugegriffen wurde oder die heruntergeladen wurden, sind vertraulich zu behandeln und an niemanden außerhalb der abonnierenden Gesellschaft/Organisation weiterzugeben. Kunden verpflichten sich, alle erforderlichen Maßnahmen zu ergreifen, um eine nicht genehmigte Vervielfältigung oder Verbreitung empfangener Daten zu verhindern.
3. RECHTE DES GEISTIGEN EIGENTUMS
Alle bereitgestellten Daten unterliegen dem Urheberrecht verschiedener Informationsproduzenten und/oder der Informationsstelle.
Der Abonnent ergreift alle Maßnahmen, die die Informationsstelle vernünftigerweise verlangen kann, um die Rechte des geistigen Eigentums zu schützen.
Der Abonnent erkennt an, dass sein Abonnement keinerlei Eigentum an Daten oder sonstigen Rechten des geistigen Eigentums in Bezug auf die Daten oder sonstigen Informationen begründet, die durch das Jahrbuch oder die Informationsstelle bereitgestellt wurden. Der Abonnent hat keinerlei Rechte an den Daten oder sonstigen von der Informationsstelle empfangenen Informationen/Dokumenten und kann keine solche Rechte geltend machen.
Der Abonnent erkennt an, dass jegliches durch das Jahrbuch bereitgestelltes Material (wie Schulungsmaterial oder technische Informationen) dem Eigentum und/oder dem Urheberrecht der Informationsstelle oder einer sonstigen Person oder Körperschaft, die Urheberrechte an den genutzten Informationen hat, unterliegt.
4. HAFTUNGSBESCHRÄNKUNG
Die Informationsstelle stellt dem Abonnenten alle Daten und sonstigen Informationen „WIE VORHANDEN“ und „WIE VERFÜGBAR“ bereit, ohne irgendwelche ausdrücklichen oder stillschweigenden Zusicherungen, Vereinbarungen oder Gewährleistungen, die entweder tatsächlich oder kraft gesetzlichen oder sonstigen Rechts bestehen, einschließlich aber nicht beschränkt auf Gewährleistung der Marktgängigkeit oder Eignung für einen bestimmten Zweck. Die Informationsstelle unternimmt alle Anstrengungen, Dienste von bester Qualität zu erbringen.
Der Abonnent erkennt an, dass die mit dem Jahrbuch angebotenen Daten und sonstigen Informationen aus Materialien zusammengestellt sind, die der Informationsstelle von externen Quellen bereitgestellt werden, und lediglich als Referenzquelle genutzt werden sollten. Die Informationsstelle und ihre Drittquellen geben keine Gewähr, dass die bereitgestellten Daten, Dienste oder sonstigen Informationen keine Irrtümer, Lücken oder sonstige Ungenauigkeiten enthalten. Die Informationsstelle gibt keine Gewähr, dass die Nutzung des Jahrbuchs durch den Abonnenten, einschließlich aber nicht beschränkt auf den Zugang zu Daten, die Funktionsfähigkeit der Suchwerkzeuge und sonstiger Software und Dokumentation, unterbrechungsfrei oder fehlerfrei erfolgt oder dass die gewonnenen Erkenntnisse nutzbringend sein oder den Anforderungen des Abonnenten entsprechen werden.
Die Informationsstelle, ihre Mitarbeiter oder Drittquellen haften nicht wegen Vertragsbruch, Gewährleistungsbruch, unerlaubter Handlungen (einschließlich Fahrlässigkeit), Produkthaftung oder aufgrund einer anderen Anspruchsgrundlage für direkte, indirekte, zufällige, besondere oder Folgeschäden (unbeschränkt einschließlich jeglichen entgangenen Gewinns oder Datenverlusts, Geschäftsunterbrechung oder sonstiger Vermögensschäden) aufgrund oder im Zusammenhang mit der Nutzung oder nicht möglichen Nutzung der Jahrbuch-Daten und Dienste, selbst wenn der Informationsstelle die Möglichkeit solcher Schäden angezeigt wurde. Der Abonnent trägt die alleinige Verantwortung für die Nutzung der Daten, Informationen und Dienste, die im Rahmen seines Abonnements angeboten werden. Die Haftung der Informationsstelle oder die ihrer Drittlieferanten ist in jedem Fall auf die Abonnementgebühr begrenzt, die vom Abonnenten während des unmittelbar vorausgegangenen Zwölfmonatszeitraums seines Abonnements entrichtet wurde.
5. ZITATE UND VERVIELFÄLTIGUNG VON INHALTEN AUS DEM JAHRBUCH
Abonnenten dürfen einzelne Daten aus dem Jahrbuch in Präsentationen oder Berichten nur unter Angabe der Quelle „© European Audiovisual Observatory“ oder „© Observatoire européen de l'audiovisuel“ oder „© Europäische Audiovisuelle Informationsstelle“ zitieren.
Die Vervielfältigung einer ganzen Tabelle oder einer Abbildung aus dem Jahrbuch in einer öffentlichen Präsentation oder in Berichten oder auf Webseiten bedarf der ausdrücklichen Genehmigung der Europäischen Audiovisuellen Informationsstelle. Die Europäische Audiovisuelle Informationsstelle kann nur die Reproduktion der Tabellen oder Abbildungen gestatten, die mit „Quelle: Europäische Audiovisuelle Informationsstelle” gekennzeichnet sind. Alle anderen Einträge können nur im Einverständnis mit der Originalquelle reproduziert werden.
